Place of defense: FACULTAD DE DERECHO. Place of preparation: FACULTAD DE DERECHO. Summary: This Doctoral thesis analyzes the legal system of immigration and asylum in the European Union. To that end, it was first performed an analysis of the right to part from the original founding treaties prior to the reform of the Single European Act, until the current regime, focused mainly on the Amsterdam Treaty, as the Nice Treaty has only some modifications of a formal nature. There was however lost sight of the draft European Constitution that could have great significance in this area. Secondly, it conducts a study of substantive law and directs attention to the input, output and control measures for immigration and asylum issues that we felt were the most significant in dealing with immigration policy and asylum in the European Union. This has forced us to carry out a study of rules that have different legal nature and effectiveness, the content of which we wanted to order and systematize. Thus, it should be noted that many of these rules have no binding effect, while others, if binding, with a minimum content aimed at harmonizing national laws on the subject from the point of view repressive. However, it can be said that, despite the significant steps that have been taken with the Amsterdam Treaty, immigration and asylum policy in the European Union is still nascent.
PROSPECTS FOR THE DEVELOPMENT OF AN AUDIOVISUAL AREA IN THE COUNTRIES OF THE SOUTHERN CONE OF LATIN AMERICA: ELEMENTS FOR AN ANALYSIS AND DIAGNOSIS OF TELEVISION.Author: FERNÁNDEZ MEDINA FRANCISCO JAVIER. Summary: The objective of this dissertation is to determine the elements of the television company as an actor and within society and identify the similarities and differences of this medium industries in the countries that make up the Southern Cone of Latin America: Argentina. Bolivia, Brazil, Chile, Paraguay and Uruguay. Once the elements for the diagnosis of television and conducted its analysis, consider the dynamics of television in the study region and the potential for development of an audiovisual area. This methodological tools are taken as the industrial economy and the political economy. The first vision of the actual sequence of markets (baseline conditions, structure, strategies and actions, and results), while the second explains the great relationship between the media and the states, through the the existence of public television channels, the relationship and mutual influence between the private sector of television and the various governments and by the laws governing the sector. The hypothesis raised is that from the analysis of the televisions in the region and their contexts, we can say that there are structural foundations on the market to develop an audiovisual area in macroespacio regional Southern Cone of Latin America. This means that broadcasters of the countries that make up this macroespacio Regional have the same characteristics in its structure, are oligopolies, with strong components of corporate concentration of multimedia and are a mixed model of ownership, where public television persist with varying degrees success. Summary: It performs an analysis of the construction process of MERCOSUR as a region, political process complex, multidimensional and answered in a very specific time - "long first decade" ( 1990-2001) in which he noted the predominance of a hegemonic way of structuring the region. In the first part deals with the study of structural context that fits the birth of MERCOSUR focusing on the understanding of the theory and practice of a global society in a profound restructuring. Summary: This paper analyzes the council of the EU, the main legislative institution community, from a constitutional perspective. This is on one hand to describe the influence of the size and organizational bureaucracy in the decision-making process of the board, bearing in mind the principles of advertising and political accountability of representatives. On the other hand, explaining the system's decision-making council, particularly the most qualified, through its contrast with the concept of parliamentary political process. From this perspective, the overall trend in the consensus of the political system Community can only be understood as a consequence of the difficulty of introducing the majoritarian principle as a requirement of democratic principle at the European level.
